Wills, Supplemental Needs Trusts, and ABLE Accounts

A will is the first step to estate planning. Estate planning involves many other pieces besides a will. Revocable Living trusts, HIPPA authorizations, Advance Directives, and Durable Financial Powers of Attorney are just some other important items that you need to have within an estate plan. A will is a good first step to ensuring your wishes are followed when you can’t be here.

A special needs trust is the next step. It is the vessel, or document, that holds assets and protects eligibility for SSI/Medicaid. It supplements things that SSI does not pay for. The document tells what the money can and cannot be used for. It also designates a beneficiary when the person with a disability has passed away. (It is NOT subject to Medicaid Payback)

An ABLE Account is a tax advantaged savings account for the person with a disability. It will pay for daily needs and “quality of life” expenses. It also protects eligibility for SSI/Medicaid. Limited annual contribution is $19,000 (2026) and lifetime contribution totals $100,000. It is subject to Medicaid Payback.
